BOOKING TERMS
GUARANTEED RESERVATION
In the case of a guaranteed reservation, i.e. confirmed by credit card, bank transfer, or cash – a payment of 50% of the package/stay value is always required depending on the documents received by Guests from Hotel Villa Park MED&SPA.
CANCELLATIONS
In case of stay cancellation for which a confirmation payment has been made – the paid amount is non-refundable. However, Hotel Villa Park MED&SPA may offer the Guest another convenient stay date within 30 days subject to availability of free rooms. If the reservation concerns long weekends and holidays, the paid money is non-refundable and cannot be used for another reservation.
OBLIGATIONS
The Guest is required to settle the full or remaining payment for the package/stay at check-in. If refused, the Receptionist has the right to refuse the room key. For additional services ordered during the stay, the Guest must settle the payment at Reception when the amount exceeds 1000 PLN.
ADDITIONAL INFORMATION
The Hotel reserves the right to require upfront payment in case of first-time Guests.
If declined, the Receptionist must refuse to issue the room key. The Receptionist must request bill settlement in advance if the bill exceeds 1000 PLN.
If tobacco smell is detected in the Guest’s room, a disinfection and deodorization fee of 900 PLN will be charged.
TERMS AND CONDITIONS FOR ELECTRONIC HOTEL SERVICE RESERVATIONS (hereinafter: the "TERMS" )
PRELIMINARY PROVISIONS
- These Terms define the type, scope, conditions, and rules for making, canceling, changing, and settling reservations within the electronic service provided by the Service Provider (as defined in point 2 of the Terms) for the Client (as defined in point 2 of the Terms).
- The Terms are the regulation referred to in Article 8(1)(1) of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2017.1219, as amended).
- The Service Provider (as defined in point 2) declares to be authorized to mediate – based on a separate agency agreement – in concluding contracts related to room reservations between the Facility and the Client.
- The Terms are made available free of charge to everyone.
- The Terms are available within the reservation system on the website of the respective Facility (as defined in point 2).
- The Terms are provided in a format allowing storage and reproduction in the normal course of business (HTML document format). Upon Client's request, the Service Provider will send a PDF copy of the Terms to the given Client's email address.
DEFINITIONS
The following terms used in the Terms shall have the meaning set forth below:
- Facility – the entity on whose behalf the Service Provider acts (based on a separate agreement) as an agent providing electronic services, including the Service described below;
- Client – means any natural person over 18 years old with full legal capacity, legal person, or organizational unit without legal personality but recognized as having legal capacity by law, who meets the requirements described in the Terms and uses the Service, particularly making or canceling reservations in the System;
- Terms – means these Terms, prepared and applied by the Service Provider;
- Agreement – means the contract for the room reservation service concluded electronically, whose subject is the provision of the Service referred to in these Terms;
- Service – means the electronic room reservation service for the Facility provided by the Service Provider to the Client, consisting in making, changing, or canceling reservation(s) of selected room(s) and enabling payment for the reservation. A detailed description is provided in point 3 of these Terms;
- Service Provider – Profitroom Sp. z o.o. based in Poznań, ul. Roosevelta 9/3, 60-829 Poznań, registered in the National Court Register under No. KRS 0000303746; VAT ID: 525-24-23-458; REGON: 141374990;
- Electronic Service – provision of a service without simultaneous presence of parties (remote), by transmitting data at the individual request of the service recipient, sent and received using electronic data processing equipment, including digital compression and data storage, wholly transmitted via a telecommunications network under the Telecommunications Law of 16 July 2007;
- IT System – a set of cooperating IT devices and software that process, store, send, and receive data via telecommunications networks, using telecommunication terminal devices under the Telecommunications Law;
- System – Profitroom Booking Engine reservation system owned and operated by the Service Provider, enabling Clients to make, change, or cancel room reservations and payments;
- Electronic communication means – technical solutions including IT devices and supporting software enabling remote individual communication via data transmission between IT systems, especially email or text messages (SMS).
TYPE AND SCOPE OF THE SERVICE
- Under these Terms, the Service Provider provides electronically the service of making, changing, or canceling reservations of selected room(s) at the Facility and payment services related to reservations. The Service Provider does not conclude hotel service contracts on behalf of the Facility, and is not obliged to provide other services except those related to room reservation management. Such contracts are concluded under terms set separately by the Facility.
- Conditions for providing the Service are:
1. Familiarization with and acceptance of these Terms by checking appropriate boxes in the reservation form in the Service Provider's System;
2. Declaration of:
- truthfulness of data provided to the Service Provider;
- consent to personal data processing by the Service Provider for the purpose of providing the Service;
- acknowledgement of voluntary data submission and rights under the Personal Data Protection Act;
- choice of payment method and possible VAT invoice issuance if required by the Facility's pricing conditions.
- Providing the Service is possible only after completing the reservation form in the Service Provider's system, accepting these Terms, and submitting the declarations mentioned in point 3.2.2.
- Internet connection and active, properly configured email account are required to use the service.
- Use of the Service is voluntary.
- The Service is free; however, the Client may incur costs from internet providers, for which the Service Provider is not responsible.
RESERVATION AND CANCELLATION
- To use the Service, a unique email address and filling out the reservation form within the Service Provider's system are required.
- Client’s reservation includes the following steps:
- selecting hotel services offered by the Facility based on data and information provided in the System, including availability and price; prices are gross and cover only indicated services;
- entering required data (name, unique email, phone number) in the reservation form on the Facility’s website;
- confirmation of familiarity and acceptance of the Terms and submission of required declarations. Failure to confirm acceptance or submit declarations prevents the reservation from proceeding;
- payment if required by Facility pricing;
- after entering data and acceptance, the Client will automatically receive an email with reservation code, confirmation, payment terms, and change/cancellation rules. The reservation agreement is considered concluded upon sending the confirmation.
- The Service Provider reserves the right to refuse reservation due to lack of free rooms. In such case, the Client will automatically receive a notification email about inability to reserve.
- Canceling a reservation by the Client includes:
- selecting "Modify" in the reservation confirmation email;
- this will open the reservation management system in a web browser; choose "Cancel" and provide cancellation reason;
- after cancellation, the Client will receive an automatic email with cancellation confirmation; if canceled free of charge and payment was made, the amount will be refunded to the original payment account.
- Modifying reservation by the Client includes:
- selecting "Modify" in the reservation confirmation email;
- this will open the reservation management system; choose "Modify" and describe in detail the requested modification;
- after sending the modification request, the Facility will contact the guest to inform about the modification status.
SERVICE PROVIDER'S OBLIGATIONS
Regarding the Service, the Service Provider must:
- comply with these Terms;
- provide the Service with due diligence.
- In case of unplanned service unavailability or failure making the Service impossible, the Service Provider will diligently restore System functionality but is not liable for the Client’s inability to use the Service or any damages unless caused intentionally by the Service Provider.
- The Service Provider reserves the right to block the Client’s email address if Terms or laws are violated.
- The Service Provider does not guarantee uninterrupted Service and is not liable for outages caused by technical reasons, maintenance, or issues on Client’s or third parties’ side.
CLIENT'S OBLIGATIONS
While using the Service, the Client must:
- comply with all Terms provisions;
- comply with laws, good manners, and general internet use principles;
- correctly provide Client data, especially required for reservations;
- immediately inform the Service Provider of any security breaches or issues with the Service;
- refrain from any activities endangering the System or third-party IT systems;
- not use the System directly or indirectly for illegal or improper purposes or violating third-party rights.
LIABILITY
- The Service Provider is not liable for Service interruptions caused by IT system failures beyond their control.
- The Service Provider is not liable for inability to use the Service due to errors made by the Client in making, changing, or canceling a reservation.
- The Client is solely liable on the principle of risk for any consequences or damages suffered by the Client, Service Provider, or others related to:
- Client’s breach of the Terms;
- improper use of the System against its intended purpose or instructions;
- failure to secure Client’s IT systems.
4. The Service Provider does not control or verify damages caused to the Client or third parties resulting from the Client’s use of the Service, particularly damages related to:
- destruction, damage, or interruption of the Service or any software used by the Client;
- introducing harmful software (e.g., viruses) or data into the Client’s IT system, including resulting damage to hardware or software.
5. The Service Provider is not liable for damages caused to the Client due to System defects, malfunctions, failures, or inability to use or incorrect Service operation caused by System failure or defect.
- No party is liable for damages caused by force majeure.
- The Service Provider’s liability for lost profits of the Client is excluded.
- Liability exclusions or limitations do not apply where prohibited by mandatory law, particularly not for intentional damages.
COMPLAINTS
- Complaints relating to Service provision should be submitted in writing to the Service Provider’s headquarters or electronically via the Service Provider’s email address.
- Complaints should include Client’s name, address, email used for reservation, and a description of the problem.
- Complaints will be processed on a first-come basis under the stated conditions.
- The Service Provider will respond to complaints within 14 business days from receipt, providing the reply in the same form as the complaint, to the email or correspondence address provided.
- If additional information is needed, the Service Provider will request it from the Client within the complaint processing period. The deadline for complaint processing then starts upon receipt of the completed complaint.
PERSONAL DATA
- The data controller is MPM Hotele SPA Sp. z o.o., Milanówek, ul. Brzozowa 3, 05-822 Milanówek, KRS: 0000175947, REGON: 016865236, NIP: 5291626119.
- The Data Protection Officer is Mr. Łukasz Grabowski, contactable at iod@mpm.pl.
- The Controller processes personal data to manage room reservations and services offered by entities related to MPM Hotele SPA Sp. z o.o.
- Data processing is based on Art. 6(1)(b), (c), and (f) of the GDPR.
- For reservations and related services, processed personal data include name, surname, address, email address, phone number, and bank account number.
- Data is stored for 3 years from registration.
- Data may be stored longer if required by law.
- Data is protected by technical and organizational measures to ensure adequate security.
- The Controller may obtain data from third parties who can book stays on behalf of Customers.
- The Controller does not collect data from publicly available sources.
- Personal data is transferred to the Service Provider, Profitroom Sp. z o.o., for enabling hotel room reservations.
- Data may be shared with third parties responsible for payment processing – these are separate data controllers.
- The Client has the right to:
- access information on data processing, categories of data, and recipients;
- request correction or completion of data;
- request deletion of data or object to processing;
- request restriction of processing if legal conditions are met;
- data portability;
- lodge a complaint with the supervisory authority, President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw, if data are processed unlawfully.
- Data is not subject to automated processing including profiling.
PROHIBITION OF UNLAWFUL ACTIONS
- The Client must not use the Service for purposes inconsistent with laws, social norms, good practices, or commonly accepted rules.
- The Client must use the Service solely in accordance with its intended purpose and functionality defined in the Terms.
FINAL PROVISIONS
- These Terms come into effect upon publication on the Facility’s website and apply to reservations made after 2018-03-22.
- The Service Provider may amend these Terms anytime at its discretion, particularly in cases of:
- need to comply with mandatory legal provisions or legal changes affecting the Terms;
- need to comply with recommendations, interpretations, rulings, decisions of authorities or courts impacting the Terms;
- expansion or change of the System’s functionality;
- introduction of new Services, changes in scope or nature of Services;
- changes in technical conditions for Service provision;
- changes in the Service Provider’s scope of activity.
- If any provision of the Terms is invalid under mandatory law, it does not affect validity of other provisions.
- Any disputes regarding these Terms will be resolved by courts competent for the Service Provider. This does not apply to agreements with consumers, for whom the competent courts are regulated by consumer protection laws.
- Polish law applies. In matters not regulated by these Terms, relevant provisions of Polish law apply, including the Civil Code and the Act on Electronic Services, GDPR, and national Personal Data Protection Act.
INFORMATION OBLIGATION
In accordance with Article 13 paragraphs 1 and 2 of the European Parliament and Council Regulation EU of April 27, 2016 on the protection of natural persons regarding the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – GDPR (OJ EU L 119/1 of 4.5.2016)), weinform you that:
- The administrator of your personal data is MPM Hotele SPA Sp. z o.o. with its registered office in Milanówek, ul. Brzozowa 3, 05-822 Milanówek, KRS:0000175947, REGON:016865236, NIP: 5291626119.
- The Administrator has appointed a Data Protection Officer, Mr. Łukasz Grabowski, who can be contacted at the e-mail address: iod@mpm.pl.
- The Administrator processes your personal data for the purposes of:
- responding to your inquiries submitted via the contact form on the website,
- sending you newsletters,
- booking rooms, as well as services offered by entities belonging to MPM Hotele SPA Sp. z o.o.
- Your data will be processed based on Article 6(1)(a), (b), (c), and (f) of GDPR.
- For the purpose of responding to an inquiry, your personal data in the form of your name, surname, and e-mail address are processed.
- For the purpose of sending newsletters, your personal data in the form of your e-mail address are processed.
- For the purpose of booking rooms, as well as services offered by entities belonging to MPM Hotele SPA Sp. z o.o., your personal data in the form of name, surname, e-mail address, telephone number, and bank account number are processed.
- Your personal data will be processed for:
- in the case of responding to an inquiry, until the answer is provided, and after that period, for 1 year,
- in the case of newsletters, until consent to such processing is withdrawn,
- in the case of booking rooms and/or services, for a period of 3 years from the registration of the data.
- Your personal data may be processed for a longer period than stated above if required by applicable laws.
- Data are protected by technical and organizational measures to ensure an appropriate level of security, in accordance with applicable regulations.
- The Administrator may obtain data from third parties who may book your stay in hotels belonging to the Administrator.
- The Administrator does not obtain data from publicly available sources.
- Your data will be transferred to a service provider, Profitroom Sp. z o.o. with its registered office in Poznań, ul. Roosevelta 9/3, 60-829 Poznań, KRS 0000303746; NIP: 525-24-23-458; REGON: 141374990 – the data will be transferred to enable you to book hotel rooms.
- Your data may be transferred to third parties responsible for processing payments for rooms and/or services – these entities are separate controllers of personal data.
- You have the right to access:
- information about the processing of the Data, including categories of processed Data and potential recipients;
- request correction of inaccurate Data or completion of incomplete Data,
- request deletion of Data – by objecting to their processing,
- request restriction of Data processing – if legal requirements justifying such restriction are met,
- data portability – by receiving Data in a format allowing transfer to a third party chosen by the User,
- withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal,
- file a complaint with the supervisory authority President of the Personal Data Protection Office, ul. Stawki 2, 00–193 Warsaw – if it is found that Data is processed unlawfully.
- Your data will not be subject to automated processing, including profiling.
